CSFM Meeting Notes
December 1, 2004


In attendance: David May, David Colby, Dennis Spackman, Verdon Walker, Liz Yeomans, Lee King, Tom Hopkins, Michelle Baguley

We were told that copies of the Midvale Slag, Master Development Agreement had been received by the city and that things were as expected. The attorneys are reviewing the structure of the deal and the legal doc's should be complete in 45-60 days. The sticking points may be the Open Space definitions and conveyance.

ENTAC began the baseline air monitoring this week. The compound should be set up sometime this month. The city is working on a water line for the compound.

The groundwater monitoring at the site is complete and the existing wells will be abandoned soon.

Things are moving forward and we are encouraged that this is the real deal.

There were some surprises at Sharon Steel with the settlement tests. The phasing of the development may be rearranged. Bonding and financing are up in the air.

The Master Development Agreement for Sharon Steel was received in October. The Mayor signed it today.

The city is still negotiating with the developer on the reimbursement agreements. The city is not willing to issue bond anticipation notes until after the increment flows. The concerns are: What's the risk, How do you mitigate it, and are you willing to accept it?
There is an outside investment group looking at the site. This requires some additional due diligence on the cities part. It is necessary to identify all of the surprises. There are some concerns about marketing challenges and competition.
The settlement data is inconsistent with the model predictions. This is causing a slow down which increase cost. The Build out time frame may be unrealistic. There must be a fiscally conservative approach to this site as there are still many unknowns.

UDEQ completed its quarterly site inspections at Sharon Steel last week. The annual groundwater monitoring was also done. There is one dry well that will be abandoned next spring. The artesian well has been regenerated because of the recent rain. The water in this well is still artesian and not affected by contamination.

CSFM will receive a copy of the report when it is finished. Tom Hopkins will review and report in our January meeting. The site looks good and remains protective. One note of concern is that the BOR indicated that their is some asbestos left in place on the site. Liz is investigating this and will tell us more in January.

CSFM offered to post the quarterly site inspection reports on our web page. Liz agreed this is a good idea and will confirm with her management.

We talked about some things to make the web site more user friendly.
Verdon asked if Superfund ever re-evaluated the action levels at remediated sites. Liz indicated that EPA is looking at some sites right now to determine if the action level was protective.
